Welcome to IPLocate!
IPLocate (IPLocate Pty Ltd, ACN 687 851 261) is an internet service for finding data associated with Internet Protocol (IP) addresses. IPLocate may be referred to as "IPLocate," "we," or "us" throughout this document.
The services that we operate include the IPLocate.io Website, available at https://iplocate.io/; the IPLocate geolocation and IP address lookup services available via web and API; the downloadable databases we offer; and all relevant infrastructure used to operate the aforementioned services. These services will collectively be referred to as IPLocate Services.
Our Terms of Service include this introduction and all of the following sections, and are supplemented by our Privacy Policy and Data Processing Agreement, all of which are incorporated by reference here. Collectively these are our Terms of Service (“Terms”), which forms a legal agreement (“Agreement”) between IPLocate Pty Ltd and you or the entity you represent (“you” or “your”). This Agreement governs your use of IPLocate Services. If you don't agree, you must not use IPLocate Services.
This Agreement is effective upon the date you first access or use the Services (“Effective Date”) and continues until you or IPLocate terminates it (this period, the “Term”).
In order to use IPLocate, you agree to the following conditions:
Subject to your continuing compliance with this Agreement and timely payment of any applicable fees, we grant you a non‑exclusive, worldwide, revocable license to:
Access and query the IPLocate API; and
Receive, store, process, and display the data returned by the API.
Request quota. Your plan tier, if you have an active paid subscription, or the free tier otherwise, includes a daily or monthly quota. You are not permitted to make more requests than your quota allows; the API will return an error if you exceed your quota.
Security. You must keep your API keys confidential and implement reasonable technical and organisational measures to protect them.
Prohibited content. You may not use the API to develop or provide content that is unlawful or infringes the rights of others.
When you purchase a subscription to any paid downloadable IPLocate database (a “Database Subscription”) the following terms apply.
Upon our making the database available for download, and subject to your active Database Subscription, IPLocate grants you a revocable, non‑exclusive, non‑transferable license to use that database for your own Internal Business Purposes (the “Database License”). The Database License commences on the date of your first payment and automatically terminates when the corresponding Database Subscription expires or is cancelled for any reason.
Internal Business Purposes means the use of our Services for content customization, fraud prevention, geographic reporting, and similar, provided that you do not:
Examples of Internal Business Purposes include:
In addition to the restrictions above, WHOIS, ASN, and Abuse Contact information provided by IPLocate must be only be used for purposes related to cybersecurity, fraud prevention, network and infrastructure monitoring, internet research, and related activities.
WHOIS, ASN, and Abuse Contact information must not be used for advertising or marketing purposes or any related activity.
Within 30 days after the Database License terminates you must permanently delete all copies of the database, including backups, caches, archival, and disaster‑recovery copies, and email IPLocate a written certification of deletion. You may retain derived, aggregated, or anonymised datasets that cannot be reverse‑engineered to recreate individual IPLocate records.
No more than once in any 12‑month period, on at least ten (10) business days’ written notice, IPLocate may audit your compliance with the post‑termination obligations. You must provide reasonable assistance and access to relevant records.
Redistribution, resale, public display, or sublicensing of any portion of a paid downloadable database is prohibited unless you have executed a separate written agreement with IPLocate expressly permitting such activity.
We offer licenses for the IPLocate API and paid databases to cover redistribution, reselling, and other uses that fall outside of the scope of Internal Business Purposes. These licenses require an explicit written agreement with IPLocate, separate to this agreement. Contact [email protected] to discuss your use case.
We offer a range of free downloadable databases on IPLocate and GitHub.com. You may use our free downloadable databases for any purpose in accordance with the license.
The license for free databases is the Creative Commons Attribution-ShareAlike 4.0 International License.
Using the free databases requires attribution. You can satisfy this requirement by including a link to iplocate.io in your application or website.
IP address geolocation is inherently imprecise.
IP addresses refer to networks and devices, not specific people. We do not aim to provide geolocation data to identify any specific person or group of people.
We aim to provide geolocation data with accuracy to a given city, suburb, town, or postal code. The most precise accuracy radius covered by our data is 1 kilometer. Our geolocation data does not, and does not attempt to, provide accuracy to a specific street, house, or building.
Our data includes latitude and longitude data points. These are not precise measurements, even if they are given to multiple decimal places of accuracy, and should not be considered as such. The latitude and longitude data points usually correspond to the center of an identified city, suburb, town, or postal code, or a nearby feature like a public park.
You must not:
See also the Data accuracy section below.
We update our databases regularly to ensure that we can provide up-to-date data through our services, and we use measures to verify the accuracy of the data provided. However, our data comprises hundreds of millions of data points collected from thousands of sources, and we cannot avoid all inaccuracies. As such, we make no guarantees to the accuracy of the data provided. IP addresses cannot always be accurately geolocated to precise locations.
We have a support email address, [email protected], and we'll endeavour to answer all queries in a reasonable amount of time.
We don't offer guaranteed support response times or an SLA unless we have a separate agreement with you. In that case, the separate agreement will take precedence over these terms.
From time-to-time, IPLocate Services may be unavailable due to network maintenance or outage - either of IPLocate or one of our server or network providers. If maintenance is planned, we will endeavour to give you as much prior notice as is reasonably possible to let you know that your IPLocate Services might be inaccessible. If an outage is unexpected, we'll try to keep you updated via our dashboard or e-mail, but please note that this isn't always possible.
Because of the inherent nature of internet services, we don't provide any compensation or credits for downtime or unavailability of the IPLocate Services - whether expected or unexpected. If you use IPLocate Services, you agree that you are not entitled to compensation of any kind for any period of time in which your IPLocate Services might be unavailable to you or others. We don't provide a Service Level Agreement (SLA) or guarantee on the uptime of IPLocate Services beyond what we've stated above.
IPLocate may use your name, logo and other marks to identify you as a user of the Services on IPLocate's website, marketing materials and other publicity materials.
This Agreement commences on the Effective Date and continues until terminated by either party in accordance with this section.
Either party may terminate this Agreement for any reason by providing the other party with at least thirty (30) days' written notice. If we terminate for convenience, we will provide you with a pro-rata refund for any prepaid, unused fees for the period following the effective termination date.
We may suspend your access to the Services and/or terminate this Agreement immediately and without prior notice if you:
a. are in material breach of this Agreement, including, but not limited to, failure to pay applicable fees or a violation of the API or Database License terms; b. cease to operate in the ordinary course, make an assignment for the benefit of creditors, or become the subject of any bankruptcy, insolvency, or similar proceeding.
Upon termination of this Agreement, your license to use the Services ends. You must immediately cease all use of the Services and, for database users, comply with all post-termination obligations, including the deletion of databases.
All sections of this Agreement which by their nature should survive termination will do so, including, without limitation, accrued rights to payment, post-termination obligations, audit rights, warranty disclaimers, indemnification, and limitations of liability. Specifically, the following clauses will survive termination: 'Post‑termination obligations', 'Audit right', 'Geolocation accuracy', 'Data accuracy', 'Payment, refunds and plan changes', 'Warranty and Liability', 'Indemnification', and 'Governing Law and Jurisdiction'.
You agree to indemnify, defend, and hold harmless IPLocate and its directors, officers, employees, and affiliates from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services in breach of this Agreement; (b) your violation of any applicable law or the rights of any third party; or (c) any content or data you process, store, or display using the Services.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." IPLOCATE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. IPLOCATE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
NOTHING IN THIS AGREEMENT IS INTENDED TO EXCLUDE, RESTRICT OR MODIFY ANY RIGHT OR REMEDY YOU HAVE IN STATUTE (INCLUDING THE AUSTRALIAN CONSUMER LAW) WHICH CANNOT BE EXCLUDED, RESTRICTED OR MODIFIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL IPLOCATE BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SERVICES OR WITH THE DELAY OR INABILITY TO USE THE SERVICES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IPLOCATE'S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, IS LIMITED TO THE TOTAL FEES YOU PAID TO IPLOCATE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
This Agreement is governed by and construed in accordance with the laws of the Australian Capital Territory, Australia, without regard to its conflict of law principles. The parties irrevocably agree that the courts of the Australian Capital Territory shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Agreement or its subject matter.
These Terms, including the incorporated Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and IPLocate and supersede all prior agreements and understandings, whether written or oral, concerning the subject matter.
